Terms of Service

1. Who this agreement is between

These Terms of Service ("Terms") govern your use of Hush (the "Service"), operated by [LEGAL ENTITY NAME] ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

These Terms incorporate our Privacy Policy and End User Agreement by reference.

2. Adults only

The Service produces sexually explicit fiction and is strictly for adults. You must be at least 18 years old, or the age of majority in your jurisdiction if that is higher, to create an account or use the Service.

By using the Service you represent that you meet this requirement. We may terminate any account we believe belongs to a minor, without notice and without refund.

You are responsible for ensuring that accessing sexually explicit material is lawful where you are. The Service is not available where such material is prohibited.

3. What the Service does

Hush generates original works of fiction from preferences you provide, and narrates them as audio. Stories are produced by automated systems — large language models and text-to-speech engines — operated by us and by third-party providers.

All content is fiction. Characters, events, and situations are invented. Any resemblance to real people or events is unintended and coincidental. Nothing generated by the Service is a statement of fact, advice, or a depiction of any real person.

Because the content is machine-generated, it may be unpredictable, inconsistent, or may not match your preferences. We do not review stories before they reach you.

4. Your account

You are responsible for keeping your password confidential and for all activity under your account. Tell us promptly if you believe your account has been compromised.

You may not share your account, sell access to it, or create an account on behalf of anyone else.

You may delete your account at any time from your Preferences page. Deletion is permanent, removes your stories, audio, and preferences, and cancels any active subscription — see the Privacy Policy for detail. Deleting your account does not restore your free-story allowance.

5. Acceptable use

You must not use the Service to attempt to generate, or to publish, content that:

  • depicts, describes, or sexualises any person under 18, or any character presented as a minor — this is prohibited absolutely, without exception;
  • depicts real, identifiable people in sexual situations without their consent;
  • depicts non-consensual acts presented approvingly as real rather than as fiction, or content promoting sexual violence;
  • depicts bestiality, incest, or other content prohibited by applicable law;
  • harasses, defames, or threatens any person;
  • infringes anyone's intellectual property or privacy rights;
  • is unlawful in any jurisdiction where you or the Service operate.

You must also not: probe or attack the Service's security; use automated means to create accounts or generate stories at scale; attempt to bypass rate limits or usage quotas; resell or redistribute the Service; or reverse-engineer it.

We may suspend or terminate any account that violates this section, remove any published story, and — where the law requires it — report the matter to the relevant authorities.

6. Publishing to the Global list

Stories are private to your account by default. If you choose to publish a story to the Global list, you make it visible to every other signed-in user, who may listen to it, like it, and download it.

By publishing, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that story to other users, for as long as it remains published. You can withdraw it at any time by unpublishing, which ends that licence going forward; copies other users already downloaded are outside our control.

You are responsible for what you publish. Do not publish anything containing personal information about yourself or anyone else.

We may remove any published story at our discretion, including on report from another user, without notice.

7. Subscriptions, billing, and cancellation

What is free. Every account may generate 1 story without paying. That allowance is once per account, not once per month, and it is not restored by deleting stories or by deleting and recreating your account. If a story fails to generate, it does not count against the allowance.

What costs money. After the free allowance, generating new stories requires an active subscription at $10.00 per month in US dollars. The price is exclusive of any taxes that may apply where you live.

Automatic renewal. Your subscription renews automatically each month, and your payment method is charged each month, until you cancel. There is no fixed term and no minimum number of months.

How to cancel, and when it takes effect. You may cancel at any time from the Subscription page in your account. Cancellation stops the next renewal; it is not a refund of the month you are in. You keep access to story generation until the end of the period you have already paid for, and after that your account reverts to the unsubscribed state.

What happens to your stories if a subscription lapses. Nothing. Stories you have already generated remain in your library, readable, playable, and downloadable, whether or not you are subscribed. A subscription covers generating new stories only. We will not delete or lock your existing stories because you stopped paying.

Refunds. Payments are non-refundable except where a refund is required by law, or where we are unable to provide the Service for an extended period. If you believe you have been charged in error, contact us and we will look into it. Nothing in this section limits any statutory right of withdrawal or cancellation you may have as a consumer where you live.

Failed payments. If a payment fails, generation of new stories is paused until payment succeeds. Your existing stories remain available throughout.

Price changes. We may change the subscription price. If we do, we will give you at least 30 days' notice by email before the new price applies to you, and the change will only take effect at your next renewal after that notice. If you do not want to continue at the new price, cancel before it takes effect.

Who takes the payment. Payments are processed by a third-party payment processor, not by us. You will be redirected to the processor's own page to pay. We never see, receive, or store your card details. The processor will appear on your bank or card statement under its own billing descriptor rather than the name "Hush". Your use of the processor's payment page is also subject to that processor's own terms and privacy policy.

What we store about your subscription. Only what is needed to know whether you may generate: an identifier issued by the processor, whether your subscription is active, and when the current paid period ends. See the Privacy Policy.

8. Ownership

We claim no ownership of the stories generated for you. As between you and us, they are yours to use for your own personal, non-commercial purposes.

Be aware that the legal status of copyright in machine-generated works is unsettled and varies by jurisdiction — we make no representation that any generated story is protectable by copyright, or that you hold exclusive rights in it. Similar or identical text may be generated for other users.

The Service itself — its software, design, branding, and the name "Hush" — remains ours.

9. Third-party providers

The Service depends on third parties to function. Text generation, audio narration, email delivery, and payment processing are performed by external providers, which means the content of your preferences and stories is transmitted to them. See the Privacy Policy for who they are and what they receive.

We are not responsible for the acts or omissions of these providers, and their availability is outside our control.

10. Availability and changes

The Service is provided on an "as available" basis. We may change, suspend, or discontinue any part of it — including deleting stories or the entire Service — at any time. We will make reasonable efforts to give notice of a permanent shutdown, but cannot guarantee it.

We may update these Terms. Material changes will be reflected in the version recorded against your account, and continued use after a change means you accept it.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free; that generated content will be accurate, appropriate, or suited to your preferences; or that stories and audio will be preserved. Keep your own copy of anything you want to keep.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, data, or goodwill, arising from your use of the Service.

Our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or [AMOUNT].

Some jurisdictions do not allow certain limitations, in which case the limitations above apply only to the extent permitted.

13. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, or demand (including reasonable legal fees) arising from your use of the Service, your published content, or your breach of these Terms.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time for breach of these Terms, or where we reasonably believe it is necessary to comply with the law or protect the Service or its users.

Sections that by their nature should survive termination — ownership, disclaimers, limitation of liability, indemnity, and governing law — survive.

15. Governing law

These Terms are governed by the laws of [PROVINCE], Canada, and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts of [PROVINCE] have exclusive jurisdiction, except where mandatory consumer-protection law in your place of residence provides otherwise.
